Purchasing rules
1. General provisions
1.1. These purchase rules are intended to provide information about West Pharmacy BV, company code 92969356 ("Seller") and to explain to the buyer the terms and conditions of sale of the goods ("Goods") ("Rules").
1.2. These Rules are also intended to guide the conclusion of contracts between the Seller and the Buyer for the sale of Goods (the “Agreement”). Before purchasing Goods in our online store, please read these Rules and make sure that you understand them. Before placing an order, you, as the Buyer, must indicate that you agree to these Rules. By placing an order, you also agree to the Privacy Policy posted on the website.
1.3. According to the information provided in clause 6, the Seller reserves the right to change these Rules, therefore, before ordering the Goods, please review these Rules to understand the terms and conditions under which you will place your order.
1.4. These Rules, as well as any other Agreements between the Seller and the Buyer, are concluded in the Lithuanian language.
2. Information about the Seller
2.1. These Rules define the purchase of Goods in the e-shop https://westpharmacy.eu The seller is West Pharmacy BV, company code 92969356. E-mail: support@westpharmacy.nl
3. Goods
3.1. The photos of the Goods presented in the e-shop https://westpharmacy.eu are for illustrative purposes only. Since the screens of various devices intended for browsing the Internet may not completely correctly display the colors of the Goods, the Buyer understands that the actual color of the Goods may be slightly different from the one seen on his/her digital device.
3.2. Unless otherwise expressly stated, all Goods that are presented in the e-shop can be ordered. If the ordered Goods are no longer available for some reason, or the ordered quantity of Goods is too large to process the order, the Buyer is informed about this as soon as possible by e-mail or call and/or SMS message, and if the Buyer and the Seller do not agree on replacing the Goods with Goods of a similar nature, the execution of the order for Goods is terminated.
4. Processing of personal data
4.1. The Seller processes the Buyer's personal data in accordance with the Privacy Policy posted at https://westpharmacy.eu/pages/privatumo-politika . Please read it and make sure that all provisions specified in the document are understandable and acceptable.
5. Conclusion of a purchase and sale agreement
5.1. In the e-shop https://westpharmacy.eu, goods can be purchased by natural persons who are 14 (fourteen) years of age or older and legal entities.
5.2. By agreeing to these Rules, the person confirms that he or she has the right to purchase Goods in this e-store.
5.3. The Goods ordering process created by the Seller in the e-store gives the Buyer a chance to check the order several times and correct errors before submitting the final version of the order. Please carefully read and check the order at each step of the ordering process.
5.4. The Agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created the Shopping Cart in the e-shop, indicated his/her name, surname (in Latin letters), delivery address, postal code, selected a payment method and confirmed that he/she has read these Rules, clicks the "ORDER" button and pays for the order. In the event that the order is not paid for, the agreement is not considered concluded. The Seller reserves the right to contact the Buyer using the contact details specified in the order regarding factors related to the concluded purchase and sale agreement, or regarding any questions arising related to the execution of the agreement.
5.5. After the Buyer places and pays for the order, he/she will receive an e-mail confirming that the Seller has received the order.
5.6. Each Agreement concluded between the Buyer and the Seller (order placed by the Buyer) is registered and stored in the e-store database.
5.7. If the Seller is unable to sell the Goods, for example, because the Goods are out of stock, the order quantity is too large, or the Goods are no longer in stock, the Buyer will be informed of this by e-mail, call and/or SMS, and the Seller will not execute the order. If the Buyer has already paid for the Goods, the Seller will return the amount paid by the Buyer within 14 (fourteen) calendar days to the bank account from which the payment was made.
6. Right to change the rules
6.1. The Seller has the right to amend these Rules, including, but not limited to, regarding:
– change of payment and/or delivery terms;
– changes in applicable legislation.
6.2. Each time the Goods are ordered, the version of the Rules valid at that time shall apply.
6.3. Each time the Rules are amended, the date of amendment is provided in clause 18 of these Rules.
7. Return of Goods and Termination of the Contract
7.1. The Buyer has the right to return the purchased Goods within 14 calendar days. The Goods are returned in their original, undamaged packaging. The deadline for returning the Goods is calculated from the day after the Goods are delivered or collected from a self-service parcel terminal. The costs of returning the Goods are covered by the Buyer, unless the Buyer and the Seller have agreed otherwise.
7.2. The right to return goods does not apply to goods that have been used or whose commercial appearance is damaged, or which are not returned in their original packaging.
7.3. The right to return the Goods applies only to natural persons.
7.4. The Buyer who wishes to return the Goods and cancel the Agreement must send the Seller a completed free-form application, which would set out the decision to return the Goods and the reasons for such decision. The Seller, upon receiving such a notification from the Buyer, shall confirm the receipt of this notification to the Buyer as soon as possible.
7.5. The Buyer shall return the Goods to the Seller as soon as possible and no later than within 14 (fourteen) calendar days. This deadline shall be met if the Buyer sends the Goods before the expiry of the 14 (fourteen) calendar day period.
7.6. The Buyer who returned the Goods shall be refunded all money paid for the Goods and any delivery costs incurred in connection with these Goods.
7.7. The Buyer is liable for any decrease in the value of the Goods resulting from actions that are not necessary to establish the nature, characteristics and functioning of the Goods. The Seller reserves the right to unilaterally reduce the amount of the refund to the Buyer, taking into account the extent to which the aforementioned value of the Goods has decreased.
7.8. The Goods returned by the Buyer must be undamaged, in their original condition, and unused. The Goods returned must have authentic labels, protective bags, and the same accessories with which they were sold. The Goods returned must be in their original packaging with all accessories with which they were delivered (e.g. instructions and warranty card).7.9. When returning the Goods, the Buyer must provide the order number.
7.10. The Seller reserves the right not to refund the amount paid to the Buyer until the Goods have reached the Seller and have been verified as complying with clauses 7.7 and 7.8 of the Rules.
7.11. If the Buyer has received Goods of poor quality, the Seller undertakes to cover the costs of returning such Goods to the Buyer.
7.12. The Buyer does not have the right to return the following goods:
- Pharmaceuticals (prescription and non-prescription).
- Reimbursed medical devices.
- Goods that the Buyer has used, damaged, damaged their packaging or lost their commercial appearance due to other actions of the Buyer, as well as goods that are not fully complete (e.g., missing parts, no instruction manual or warranty booklet).
- Other goods, the return of which the seller may refuse to accept in accordance with the legal acts of the Republic of Lithuania.
7.13. The Seller has the right not to accept the goods, not to exchange them and not to refund the money paid for them if:
- The product is not complete.
- It is damaged or untidy.
- Not properly packaged.
8. Delivery of goods
8.1 Goods in Lithuania are delivered via parcel services (to self-service parcel terminals or to the specified address). Delivery time usually takes 1-7 business days. Goods in other countries are delivered by courier. Delivery time takes up to a month. The delivery price in both cases is specified at the time of ordering.
8.2. The Buyer must specify the exact address of the selected self-service terminal or delivery address when ordering.
8.3. If, upon collecting the Goods from a self-service terminal or courier, the Buyer notices damage to the package of the shipment, the Buyer must take a photo of the shipment and provide these photos to the Seller in a manner convenient for the Buyer and make sure that the Goods themselves are not damaged. If the Goods are also damaged, the Goods may be returned to the Seller, and the Seller shall cover the return costs to the Buyer.
9. Price of goods
9.1. The valid price of the Goods is indicated next to each of the Goods in the e-store.
10. Payment
10.1. The Buyer pays for the Goods using a payment card. In order to complete the order, the Buyer must make a payment, which is carried out using payment technology after the Buyer enters his payment card details.
11. Buyer's obligations
11.1. The Buyer must provide correct data in the order form. In the event that the data specified in the Buyer's order form changes, the Buyer must notify the Seller as soon as possible.
11.2. The Buyer must pay for the ordered Goods and accept them in accordance with the procedure established in these Rules.
11.3. The Buyer undertakes that before starting to use the Goods, he will inspect them and make sure that the Goods received are exactly the Goods that he ordered.
11.4. The Buyer must comply with the requirements set forth in these Rules and the legal acts of the Republic of Lithuania.
12. Seller's responsibilities
12.1. The Seller undertakes to respect the Buyer's privacy and to process the Buyer's personal data only in accordance with the procedure established by these Rules, the Privacy Policy and the legal acts of the Republic of Lithuania.
12.2. The Seller undertakes to comply with the requirements set out in these Rules.
13. Manufacturer's warranty
13.1. Certain Goods sold by the Seller may be covered by a manufacturer's warranty. Information about such warranty and its terms are provided in the manufacturer's warranty, which is attached to the Goods. The manufacturer's warranty extends the Buyer's rights in relation to Goods that are of poor quality.
14. Quality of goods
14.1. The Seller guarantees the quality of the Goods in accordance with the law. The manufacturer's warranty for the Goods is valid only if the conditions related to the operation of the Goods are not violated. The Buyer must carefully read the instructions for use of the Goods, if any, before using the Goods.
14.2. Defective Goods shall be exchanged and returned in accordance with the procedure specified in these Rules and taking into account the applicable legal acts of the Republic of Lithuania.
14.3. The Buyer may inform about poor-quality or incomplete Goods by e-mail support@westpharmacy.nl . At the same time, the order number must be indicated and a description of the defects, signs of failure or missing parts of the Goods must be provided and, if possible, photos of the aforementioned factors must be sent. In addition, the Buyer must indicate how he would like the incident to be resolved: The Goods may be replaced with similar Goods of suitable quality or the price paid for the Goods may be refunded.
14.4. The Seller undertakes to provide a response to such inquiries no later than within 14 (fourteen) calendar days.
15. Buyer's responsibility
15.1. The Buyer is responsible for storing his login data and/or transferring this data to third parties. If third parties use the services provided by the e-store by logging into the e-store using the Buyer's login data through the Buyer's profile, the Seller considers such a person to be the Buyer and the Buyer is responsible for all actions of such a third party. If the Buyer suspects that his login data may have been learned by an unwanted person or stolen, the Buyer must notify the Seller as soon as possible.
15.2. In accordance with the provisions of Article 8, Part 3 of the Law on Electronic Signature of the Republic of Lithuania, the Buyer and the Seller agree that the confirmation of the Buyer's actions in the store by logging into the personal profile has the legal force of an electronic signature established in Article 8, Part 1 of the Law on Electronic Signature of the Republic of Lithuania.
15.3. If the Agreement concluded using the e-store is violated, the parties will be liable for the violation in accordance with the procedure established by the legal acts of the Republic of Lithuania.
16. Events beyond the Seller's control
16.1. The Seller is not liable for any failure to perform or delay in performance of the Agreement or any obligations under the Agreement if such failure or delay is due to events beyond the Seller's control - actions or events beyond the Seller's reasonable control.
16.2. If an event beyond the Seller's control occurs that prevents the Seller from performing its obligations under the Agreement, the Seller shall notify the Buyer thereof as soon as possible. The Seller's obligations under the Agreement shall be suspended and the period for performance of the obligations shall be extended until the end of the events beyond the Seller's control. If events beyond the Seller's control affect the delivery of the Goods to the Buyer, the Seller shall notify the Buyer of any changes to the delivery date.
17. Sending information
17.1. All written communication between the Buyer and the Seller shall be via email.
